PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant’s signature. His DD Form 214 indicates that he was discharged under the provisions of Chapter 4-2H, AR 635-200 by reason of completion of involuntarily active duty training (IADT), with an uncharacterized discharge and transferred to the commander C Co, 40
th Support Battalion, 244 S. Taylor Ave., Montebello, CA.

         b. On 5 April 1991, the applicant was released from IADT. At the time of release, the applicant had 1 year, 1 month, and 23 days service on his current enlistment under review and 3 years total time in service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200, in effect at the time, set forth the basic authority for separation of enlisted personnel. ARNGUS and USAR soldiers who successfully complete a period of IADT to which ordered, will out-process per AR 612-201. The service of soldiers specified in this paragraph who are in entry level status will be uncharacterized, even though they have completed their IADT successfully.

(2) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The record shows that the applicant, a member of the California Army National Guard, completed over a year of active duty training for successful qualification in his primary military occupational specialty 91P (X-ray Specialist). Since the applicant was not in entry level status (e.g., first 180 days of active duty), and he was not under a split or alternate training option, characterization of his service is mandated by Army regulation. Accordingly, the Board determined the characterization of service was improper and voted to upgrade it to fully honorable. The Board found the reason for discharge, completion of active duty for training, was both proper and equitable and voted not to change it.
